The only issue is where in the world did he get that authority? Because even if we make up some fake law, Lex would want to be the one to press that button and “save the country” and there is no way he's letting some general get all the credit. And Lex is trapped alongside everyone.

Bunker wouldn't help on Braniac's ship. Even if he manages to crash back to Earth, he'd still be 2 inches tall.
